OSBIG TAKES ON GENERAL MOTORS AND TESLA AND WINS
We brought a complaint against The Huntington National Bank, General Motors, and Tesla
seeking to avoid the liens of GM and Tesla on various assets of the bankruptcy estate. The
parties filed cross summary judgment motions. The parties argued the motions which were
taken under advisement. It was clear that we would have prevailed, which gave us substantial
leverage in negotiation while the matter was under advisement. During that period of time, the
matter settled resulting in the bankruptcy estate avoiding GM and Tesla’s interest in commercial
tort claims, insurance proceeds, Chapter 5 causes of action, and a portion of the account
receivables, and assets located in Mexico.
